Can India stop Emergency like South Korea did?

You all might remember recently what happened in South Korea, the President there tried to end democracy in his country but was unsuccessful. Seeing whatever has happened in South Korea, many people in India are raising the question that suppose tomorrow, hypothetically speaking, if we think about it like this, if something like this happens in India tomorrow, if someone tries to impose an emergency, will our country’s Parliament also be able to stop that emergency?

Initially it was thought that they would impose an emergency in the country for 10-20 days and all the political opposition in South Korea would be jailed. South Korea would basically become a bit like North Korea in terms of political structure. But Jung Suk Yul’s idea failed. There are two reasons for its failure.

Firstly, there was a doubt in the South Korean army to a large extent that whether we are doing the right thing or not. An order has come from the President to enter all the government offices, enter the parliament and put any member of parliament from the opposition party in jail.

At the same time, it was also seen that suddenly an emergency session of the South Korean parliament opened, voting took place there and all the members of the parliament together passed a resolution against the president and said that we will not accept this emergency.

Do not trust this man, this man tried to end the democracy of the country. And the world saw what the President of South Korea tried to do. The South Korea issue has been resolved, whatever had to happen has happened there and it will be business as usual. It is very strange, this is very weird, there is no accountability, nothing as to why all this was done.

Now we come to India, can this happen in India?

Emergency 1975 to 1977

Well, the answer is no and I will tell you the reason why. Look, once there was an emergency in India, it was for 21 months. From 1975 to 1977, Indira Gandhi was the prime minister of the country and Fakhruddin Ali Ahmed was the president. And this was a time when genuinely Indian democracy suffered a big blow because the rights of the people were stopped at many places and the country was not in power for 21 months. The emergency was right, though I have to say this for comparison, if we talk about South Korea, then in 1970-80, there has been an emergency here as well. I have already told you about the history of South Korea, many times there has been a presidential coup here, their president was either put in jail or killed, or even before this, if you see, there have been coups.

Why Indian Democracy is better?

All this was happening in South Korea as well. You can say the period of 1960-70 was quite problematic for these young democracies. Now when the emergency in India was lifted, you must know that the emergency in India was lifted in 1977. General elections were held a little before that.

Yes, general elections were held during the emergency. Our sitting prime minister who had imposed the emergency, Indira Gandhi, suffered a huge defeat. Morarji Desai’s party, Janata Party, came to power with a huge majority. And after Indira Gandhi was removed from power, the first thing that was done in India was that the way Indira Gandhi had declared emergency, by saying that there is a threat to internal security, you must know that you can impose emergency due to three reasons, if you assume-

  1. Someone has attacked India, the country will have to work in emergency at this very moment, only then will the country be able to defend itself.
  2. External aggression has become of some other type.
  3. Not a country, but a group has attacked India from outside or through armed rebellion. In case there may be an emergency

In India, this is what our constitution says today, but in 1975, Indira Gandhi had said that there is internal disturbance in the country. Internal disturbance is a very vague word. Internal disturbance can be anything. People are protesting. Internal disturbance has happened.

So, first of all, this was done in 1978 that if tomorrow, suppose someone wants to impose an emergency in the country, then you cannot impose an emergency until there is armed rebellion. This thing was categorically cleared that from today onwards, no Prime Minister or President can impose an emergency in the country on the pretext of internal disturbance. And apart from that, another change was also made that now, suppose someone imposes a national emergency due to any other reason, suppose China attacks or something happens, in that case, if you want to keep the emergency for a long time, then in that case, you will have to conduct voting in both the parliaments and you will need a special majority, that is, a 2/3rd majority, only then that emergency will last for a long time.

Best Democracy

First of all, the way the President of South Korea has said it, it is a unique case, an ultra unique case, I mean, the more I read the details, it seems strange that how can a developed country like South Korea tolerate all this, how can these people accept all this, that their President imposed martial law, it failed and then went back to work after saying sorry, there are no reprieves, they will not have to face any issue, the US also did not impose any sanctions or did not say that democracy is in danger, everything is normal.

Here you must have understood what is the difference between the democracy of India and South Korea. Whatever comedy etc. has happened in South Korea, you will not get to see it in India, and not just in India, let me also tell you that you will not get to see this in most of the countries of the world, actually you will not get to see what has happened in South Korea in most of the democracies, even Pakistan has some standards, if they set out to show off, they do it here, then take a U-turn and forget it, nothing happened, nothing happened.
